Creditor Rights / Debt Collections
Zeleskey assists numerous banks and companies of various sizes in the collection of debts and accounts, both secured and unsecured. Debt Collection is offered as an area of practice because it is a major concern of any business, no matter how large or small. Our attorneys have experience in dealing with debtors, litigation involving debts, receiving and abstracting judgments, and executing on judgments. We also assist out of state clients in pursuing any debtors located in Texas.

• Corporate Clients

For our large corporate clients, our attorneys handle their problem accounts that cannot be collected by their in-house credit department. Most of these accounts are pursued through litigation and many are settled by means of a significant up-front payment and then continuing payments until the account is brought to a zero balance.

• Small Debts

In dealing with our small business clients, many debts fall below the $5,000 range and suits against these debtors can be filed in the Justice of the Peace Court or County Court of Law if negotiations with the debtor are not successful. This generally involves less expense but still provides the company with a judgment that can be executed upon in an attempt to seize any non-exempt property.

• Creative Solutions

The Zeleskey Law Firm can also fashion unique remedies for the collection of a portion of a debt while maximizing any tax benefits that may result in a loss to the creditor. For example, our attorneys, in cooperation with the debtor, formed a new corporation to acquire all of the debtor’s remaining assets that were not seized upon execution of the judgment. This allowed the creditor to continue operating the business while writing off its loss on the note.

• Bankruptcy

Our attorneys also represent creditors when a debtor has filed for bankruptcy protection. This representation includes filing the proof of claim, attending hearings, and monitoring payments from the bankruptcy trustee in order to maximize any possible recovery for our clients.

• Foreclosure


Another area of debt collection in which Zeleskey Law Firm concentrates encompasses foreclosures on real property. In this area, our attorneys initiate the process by sending notice to the debtor and proceeding through the process to a sale on the courthouse steps, if necessary. In this area of practice, our attorneys represent banks and mortgage companies as well as individuals who have financed real property and find that collection of the debt has become difficult or impossible.
