Real Estate Litigation
Zeleskey handles all types of litigation involving real estate, including disputes involving title to real property, suits to partition real property, disputes involving the validity of liens on homesteads and other property, enforcement of mechanic’s and materialmen’s liens, eviction proceedings, and landlord/tenant disputes. Attorneys at Zeleskey have experience in litigation involving real property and have the ability and experience needed to effectively litigate these disputes on behalf of our clients.
• Zeleskey represents buyers and sellers of real property in claims involving deceptive trade practices in a real estate transaction. We also represent buyers and sellers in interpreting and enforcing the terms of a contract for the sale of real property and in disputes involving whether the proper disclosures related to the condition of the property were made by the seller.
• Zeleskey has also represented clients under the new dispute resolution and inspection process provided by the Texas Residential Construction Commission. Utilizing this process, we were recently successful in assisting a new home owner in obtaining a new roof to replace a defective installation without resorting to litigation. • Liens on property constitute another area of our real estate litigation practice. Zeleskey has been successful in enforcing judgment liens against real property through the process of a Sheriff’s sale in order to obtain payment of a judgment for our clients. Zeleskey has also been successful in removing judgment liens against homestead property because the lien was not proper or valid against the homestead. We also assist clients who are owed money on construction projects by filing mechanic’s and materialmen’s lien claims for clients who provide labor and/or materials to a construction project. If the debt is not paid, we will file suit to enforce the lien against the property in an attempt to obtain payment for the labor and materials supplied to the project.
• Partition of real property is also an important area of our real estate litigation practice. It is not uncommon for co-owners of property to have a difference of opinion as to whether a tract of real property should be sold, divided, or kept as is. Partition allows a co-owner who wants to sell or divide the property a procedure for accomplishing this result. Zeleskey has also offered creative solutions in order to obtain an agreement to partition land by sale, thus avoiding a partition suit.
• Our attorneys are also experienced in handling cases involving adverse possession cases.
• Zeleskey represents several landlords in enforcing leases against tenants that are delinquent or are not complying with other terms of the lease agreement. These types of disputes often involve eviction proceedings and breach of contract litigation based upon the tenant’s obligations under the lease. We also have assisted clients in reaching payment arrangements that satisfy both parties and allows the landlord/tenant relationship to continue amicably.
